When parties to a big lawsuit couldn't agree on a vendor to host an electronic document repository, the court appointed me to help. Poring over multimillion dollar bids, I saw the vendors were told to assume that a gigabyte of data equals 22,500 pages. If the dozens of entities involved produced their documents in a mix of TIF images and native formats -- spreadsheets, word-processed documents, e-mail, compressed archives, maps, photos, engineering drawings -- how sensible was it to assume 22,500 pages per gigabyte?

Minnesota Follows FRCP Rules for Discovery of Electronically Stored Information

Minnesota recently amended its Rules of Civil Procedure, providing for, among other things, procedures for discovery of electronically stored information.  The amended ediscovery rules mirror those found in the Federal Rules of Civil Procedure.  The Minnesota Rules became effective on July 1, 2007.

Rule 37(f) is a new rule added by the amendments to the Federal Rules of Civil Procedure that became effective Dec. 1, 2006. It's been described by commentators in many different ways, including "safe harbor," "lighthouse" and "minefield." One of the judges who sat on the rules committee that proposed Rule 37(f), said that it's meant to be more like a "bubble bath" than a "safe harbor" -- something to make companies feel good about handling electronically stored information in litigation.

Electronic discovery, or e-discovery, is an emerging application that data classification vendors have targeted. Organizations charged with producing electronic documents for legal or regulatory compliance purposes may increasingly turn to classification tools to do so, some storage analysts say.

“A lot of people are being required to retrieve information in a very short period of time,” Oseth said. Such requirements necessitate having products with content indexing and search capabilities, he said. For example, searches based on keyword indexing can find files relevant to legal proceedings more readily that searches based on metadata.
